1. About us

PersonalizedSong.ph (the “Service”) lets you order a personalized song created from the information you give us.

By placing an order you accept these Terms.

2. What the service is

You give us your story and choose, among other things, the language, the mood, the musical style and the type of voice.

From that, we create the lyrics, the music and the vocals.

Automated technology, including artificial intelligence, may be used to create the song.

A completed order includes in particular:

• a personalized song;
• the song lyrics;
• an MP3 file;
• a Song Page where the song can be played and downloaded.

The song is usually ready in about 10 minutes after your payment is confirmed. This is an estimate, not a guaranteed delivery time.

To use the Service you need a device with internet access, an up-to-date web browser and a working email address.

3. Ordering and payment

You order through the form on the Service.

The current price of the song, in Philippine pesos, is always shown on the Service and displayed to you before you pay.

If the Service offers optional extras, their price is always shown before you make the additional payment.

There is no subscription and there are no recurring charges.

Payments are processed by an external payment provider.

The contract for an order is made once your payment has been completed.

4. Creating and delivering the song

You are responsible for the accuracy of the information you give in the form.

The song is based on the story you send, but because the process is creative we cannot guarantee that every sentence or detail will be used word for word.

The finished song is made available on the Song Page together with the lyrics and the MP3 file.

If a technical problem prevents the song from being created or delivered, we will try to fix it or deliver the song again.

A standard order does not automatically include free manual edits or any number of new versions, unless an offer clearly says otherwise.

5. The nature of generated content

Songs are created using automated systems.

Because of this, you may notice, for example:

• small differences from the sound you expected;
• unusual pronunciation of some names or places;
• unexpected turns of phrase.

Personal preferences about the melody, voice or style do not in themselves mean the song is faulty.

Being unhappy with the artistic result alone — in particular the melody, arrangement, vocals, style, tempo or wording of the lyrics — is not a reason for a refund where the song has been delivered and matches the order. A personalized song is a creative work, and how it is received is naturally subjective.

This does not affect your rights as a consumer under Philippine law.

6. Cancellation, refunds and complaints

The song is digital content made to order, individually, from the information you give us.

When you order, you ask us to start creating your song right away and acknowledge that a song made for you cannot be canceled or returned once it has been delivered, unless it is faulty or does not match your order.

You can send a complaint to [email protected]. We reply to complaints within 14 days.

If a paid song cannot be delivered for technical reasons and the problem cannot be fixed, the relevant payment will be refunded.

If the song has an objective technical fault or does not match your order, we will first try to repair it, create it again or deliver it correctly. If we cannot fix the problem or deliver a working song that matches the order, we will refund the relevant payment.

You are not entitled to a refund solely because you expected a different melody, voice, arrangement or overall artistic result. This does not apply where the song is faulty or does not match your order.

Nothing in these Terms limits the rights you have under the Consumer Act of the Philippines (Republic Act No. 7394) and the Internet Transactions Act of 2023 (Republic Act No. 11967). You may also bring a complaint to the Department of Trade and Industry (DTI).

7. Your rights to the song

You may use the song you have bought for private, non-commercial purposes.

In particular, you may:

• listen to it and download the MP3;
• send it to someone close to you;
• share the link with family and friends;
• play it at a private celebration, such as a birthday, a monthsary, a wedding or a family gathering;
• use it in a private, non-commercial video.

Without separate permission you may not resell the song or use it commercially, for example in advertising or in a paid product.

Because of the way the content is created, we do not guarantee exclusivity or that copyright protection can be obtained for every element of the generated song.

8. Content you give us

Only send content you are entitled to use.

You must not send content that is unlawful or that infringes other people's rights, reputation or privacy.

If your story contains information about other people, you are responsible for sharing it lawfully.

9. The Song Page

The Song Page can be opened by anyone who has its unique link and is not password-protected.

It is not intended to be indexed by search engines.

You decide who you share the link with.

We recommend downloading the MP3 and keeping your own copy of the song, as we cannot guarantee that the Song Page will be available indefinitely.

10. Availability of the Service

The Service also depends on external technical services.

There may be temporary interruptions, delays or errors.

If that happens, we will take reasonable steps to restore the Service and complete paid orders.

11. Final provisions

These Terms are governed by the law that applies to the operator of the Service. This does not take away the protection you have under the mandatory consumer laws of the Philippines.

Changes to these Terms do not affect orders that have already been paid for.
